The Audiencia Nacional closes the complaint against TOUS
The Judge of the Audiencia Nacional, Santiago Pedraz, has ordered the dismissal of the complaint against TOUS, rejecting any possible illegality in the commercialization of its gold and silver jewellery, which “would be guaranteed by law“ as precious metals. In the ruling, the magistrate concludes that no further action is required, as the complainants requested.
The Judge recalls the object of the investigation, which is limited to whether or not the silver jewellery made by TOUS with the electroformingtechnique is a precious metal and, specifically, whether it is a precious metal when it has a non-metallic nucleus inside it. Pedraz stresses that this question only concerns silver since, in the case of gold, the jewels made by Tous do not require more stability than the hardness of sterling gold.
After analysing the legislation on precious metals, the judge determinesthat it is permitted to keep non-metallic elements inside jewellery made with precious metals in order to give them stability. The judge rules out the commission of any crime by closing the investigation and settling all the controversy regarding this matter.
